Judges have discretion to require the ignition interlock device in all first offenses of OVI, and this device is mandatory in all subsequent offenses within six years. Some important things to know about the ignition interlock system:
- The limit of the ignition interlock: The device is set at a .02 blood alcohol content (BAC) level, which is extremely low.
- If you drink the night before: With the low .02 BAC level, it is entirely possible that you could set off the ignition interlock in the morning after you have been drinking heavily.
- If the interlock fails: Many judges will revoke driving privileges when the device fails. In other words, if you blow more than .02, which can happen with the most minimal consumption of alcohol, you could lose your driving privileges, so it is essential to use extreme caution.
